kathleen sebelius was spot on. >> millions of americans are visiting healthcare.gov, which is great news. unfortunately the site was only designed to handle six users at a time. [ laughter ] >> in total, 248 people enrolled in obama care nationwide by the end of day two according to an internal obama administration memo obtained by that oversight committee. adding to the list of white house whos is the fact that the vast majority of those signing up on state exchanges are signing up for medicaid while a much smaller number are signing up for private insurance, the administration says it will release official enrollment numbers in mid november, but, if the numbers are as bad as these reports suggest, what will the president do? joining me now to react from washington, d.c., democrat strategist julian epstein. julian, six? you couldn't make this up. if i had said six, they would call me crazy, racist, who know what is they would call me.

six. >> i'm the first to acknowledge that there have been a lot of problems with the rollout. the administration put out a figure october 2 ath where they had about 700,000 people sign up or express interest in signing up for the program. i think the question that you are getting to, eric, is the right question, will they get a sufficient number of people in to sign up, in to the marketplace or the exchanges. and i think if you look at the numbers, it's prettiy, pretty persuasive that they will get. >> how in the world do you come, they have six or maybe 248 after a couple of days. let's take 248 after a couple of days, at that rate they want to get the 7 million enrollees by march. it would take them 800 years at that rate. >> at that rate they are not going to hit their goal 700 million in march. >> let me explain why they would. >> they put out the 700,000 figure as of october 25th. initial days obviously nobody was signing up because of the problems. if you look at -- what's consider the big picture for a second.

half of all americans get their insurance through their employers. this debate doesn't affect half of all americans. another 30% of americans get their insurance through either medicaid or the military. we are talking about 20%. >> 62 million? >> approximately. 15% don't have any health insurance. the idea that a large percentage of those are not going to sign up for a system when they can get very good comprehensive healthcare at rates as low as or premiums as low as $100 a month. >> you are getting on off topic here. are they going to get the 700 million by march like they said they need to get it off and running smoothly. doesn't look like it's going to be the case. they are going to have to make a decision, julian. delay the individual mandate or delay the fine if you don't have insurance are they not? >> i think that is correct if we get into january and february and don't look like we are hitting those numbers. the reason i think we are going to hit those numbers

because again if you consider there are 45 million people that don't have insurance and incentives for them signing rupp so strong, comprehensive healthcare for as little as $100 a month in the premium. a huge portion of that 45 million are going to let go into the exchanges. then you have got another 15 million measures that are in the private markets already. who are, many of whom will have their health insurance programs policies cancelled. and a large portion of that 15 million are going to have every incentive and every desire to get into the exchanges as well. you are talking about 60 million people. >> 15 million new people are going to have to go seek out health insurance. we are not even talking about the young people, 20 and 30-year-old who's are trying to sign up and they are finding out that, a, their premiums are going up and b, the big one, julian, is that their deductibles are in the thousands of dollars a year and they're saying no my guess that's why they are holding back these numbers because they're so embarrassing low not because only web site

glitches but because someone is not enrolling in something that costs so much money. >> big part of the problem was the web site feesk co-which is a big reason why people didn't get into the program. again, the central point i'm making you are talking about a pool of 60 million people that would probably go into these exchanges or the private marketplace. and there is every incentive for almost all of these 60 million people to get into the system because the policies in the private marketplace are, one, requesting to be comprehensive. two, you are going to have tax incentives, tax rebates for millions, as many as 6 or 7 million americans to get into this program. so they can get health coverage. >> who pays for that, julianne? who picks up the tab on rebates? >> that was part of the aca, that was part of the law. that was part of -- it comes through a tax rebate. >> let's talk about where the money comes from. originally when president obama pushed this, and turned a bill into a law, the cbo said it was going to be about $900 billion.

now, they have upped that. the cbo has under that number to $1.8 trillion. we are not even talking about these additional insion incentives and rebates which is only going to add though that number. >> one how is it paid for tax increases like the medical equipment tax and increase on capital gains. there is no question there are some taxes that are paying for this secondly, the cbo also made it clear that the healthcare law was going to be a net reducer in terms of our federal deficit. >> julian, i have toil, president obama, unequivocally said this will not be a tax increase. he looked the american people in the eye in fact he was sitting down with george stephanopoulos it isn't a tax. it was never a tax. it's the law. his words. turns out, i agree with you it's a tax. >> certainly there is no question. nobody ever debated the fact that you had things you had the medical equipment tax

tonight, can president obama recover from the botched healthcare rollout? joining me now from d.c. fox correspondent ed henry. you had a little back and forth with mr. carney today, did you not? >> well, sure, because, look, what they tried to do today, because of these new numbers, suggesting that only six people signed up for the president's healthcare law on day one. those are preliminary numbers, estimates. we have to caveat that. that's a pretty embarrassingly number if it's anywhere close to that tried to blame it on darrell issa he was cherry picking data. the fact of the matter is information leaked by the administration. this is internal administration data from a war room at the health and human services department. and the bottom line is if the administration, when i was pressing jay, i was pointing out if the administration wants to end this what they call cherry picking they can do that right now. they did release the numbers that they have. we know they have some kind of numbers that they're looking at every single day at hhs in the white house. they won't release them. in the interest of transparency it might help them to actually show the

american people where we are in this. >> the most transparent presidency in the history of presidents i heard that was going to be the case. it was interesting to note they never denied the six number, did they. >> they didn't directly deny it look, their answer is that if you look at other rollouts of various things. people shot around the first few days and in this case you had the awful web situation that made it harder for people to enroll. they think these numbers are going to get better. we have to point that out. the bottom line is in these early stages it's been a disaster. >> the administration seems to have a lot of huber russ, a little bit of arrogance going forward. are they addressing kathleen sebelius? are s. her job safe. >> it is safe for run reason are ho are they going to it pick to replace her. i don't think anyone in the country would want to take on this task of figuring all this out. it's frank lay mess right now, number one, and number two, who would actually get confirmed by the senate. when you put up someone in the middle of a nomination in a battle royale like this

that gives some republicans documents out of the administration. when they had a cia pick up there in the senate that led republicans but democrats like ron widen to get drone memos and other things out of the administration. they had leverage. if you pick somebody to replace sebelius right now. that would probably mean even more political pressure on the president. i think that keeps her job safe. >> are they addressing the issue that we have been reporting and confirming that the vast majority of people signing up through the web site, through the portal are signing up for medicaid not really enrolling in obama care? you know they haven't given a full explanation of that yet. what they are hopeful of is in the early days the medicaid signups will be very high because it's basically free healthcare for people who are not covered right now. but the problem, obviously, long term is they have got to get those numbers to even out. as you were note ago moment ago get the young healthy people to sign up and pay into the system. the state of maryland real quick here in the d.c. area last week revealed late on

friday night that they had gotten about 3100 households paying into the exchange in maryland, which is a low number. had something like 82,000 taking out medicaid on january 1st, signing up for it that's a huge drain in the numbers. the math is simply not going to it add up. >> i'm glad you said that ed because i have been saying that for along time. the $1.8 trillion the cbo estimate didn't take any of this into account. when they really get down to the nuts and bolts this thing could be a monster. >> hoping to get more people to pay in to even that out. right now the numbers are not there. >> i don't know if there is no penalty for not doing it and a tax they can't enforce, the irs has no teeth to enforce it it's going to take a while. there is going to have to be some changes. we will leave it interest. thank you very much. >> thank you, eric. >> world leaders are not happy at all with the nsa spying on them. we will hear from a man at the center of that storm later, why is the university of california planning on handing out millions of dollars to illegal immigrant students? those reports after these

in the factor follow-up segment tonight, president obama's image is taking a big time hit over the spying controversy. foreign leaders are furious with him over reports that the nsa monitored private communications and americans are learning that the agency also infiltrated yahoo millions of user accounts much the leaker behind all of these is edward snowden hiding out in russia and the journalist who helped bring it to the world's attention is glen greenwald who spoke with me said that the president has not been honest with the american people. listen. >> i think he was informed but chose to tell the public things that he knew to be false. this is really been the nub

of the story from the very beginning is top nsa officials lied to the congress about what nsa does with america's communication. and president obama has repeatedly mislead the public by claiming that the nsa does not invade the content of our communications when in fact without warrants the nsa is frequently monitoring the communication of american citizens. >> not everyone sees it this way. joining me now from los angeles, fox news contributor, rick grenell the former spokesman to the u.s. ambassador to the u.n. rick, thanks for joining us. i interviewed glen greenwald. the reason we brought him on cashing in which i'm going to air it tomorrow morning on the fox news channel. the reason why i brought him on is because president obama promised the nsa was not going to look into private emails of americans. this week the "the washington post" reports that that likely happened when the nsa infiltrated google and yahoo and allowed them to have access to email accounts. now, the question is, do you think that's right? is that fair? should he be looking at americans' emails? >> well, i think the policy is that they are not looking

inside specific emails of americans if it happens to occur, it's not because it's the nsa policy. look, glen greenwald and other journalists have the responsibility to push for transparency in this program. there is no question transparency is a good thing so is congressional oversight. democrat who control the senate have been very bad about pushing the nsa and pushing that these programs and policies are are not trying to trying to sweepingly go after americans and look at their private communications. foreign intelligence coming in. and i trust them. and i think the american people should trust them. >> foreign intelligence court, right? the problem is yahoo and google aren't foreign, a lot of user accounts are right here in america. they are data mining it.

that's what the "the washington post" found out. my point is in order to do that you need probable cause and they are not doing that first. >> or you can have a special presidential directive which they do have in certain cases. look, eric, at the end of the day. >> but that's a problem. that's my problem. a special presidential directive. it's like the executive order pen. here is where the right is. the right is in the constitution. he by passing the constitution. >> there is no question about that. >> go ahead. >> we can't have a system of government where republicans only trust the republicans. and the democrats on trust the democrats. we have to rely on congressional oversight. this is a very serious program. and, let's remember, that people like glen greenawalt have never been on the receiving end of what we call the blue sheets which are intelligence-gathering policies. and when you are on the receiving end of intel briefings, it's a sobering experience. there is a huge responsibility. i get the need to try to collect everything because you are trying to keep

americans safe. we have to rely on congressional oversight committees to make sure. >> but i don't. i don't get that. >> individuals -- >> -- needle in the hay stack argument. they keep taking the hay stacks but they are not finding any of the needles. by the way when you take the hay stacks, breaking the. >> we do have a process in place, that process is relying on congressional oversight committees. if you want greater accountability we need to push the democrats in the senate to hold the democratic president responsible. clearly people like dianne feinstein have been able to have loser policy with a democrat president. that's wrong and we should hold every president accountable and push the townhouse make sure that their policies are exactly what they say they? >> listen. let me make this very clear. i only have a problem with the nsa spying on americans. i love the fact that they're listening to angela merkel's conversations world leaders around the world, knock yourself out, spy on them, they are spying on us, i get it when you go into the

american phone calls, phone lists, emails, some cases the body of the emails. that's when i have a problem with it, they variety the law. >> the only thing i style that eric is that the bad guys don't announce their plans over the internet or on their phone calls as i'm going to bomb something. what they do is they use code words. and so when you are looking for the plan, which we he have to remember that in a post 9/11 world, we have to get to them before they board the airplane. but, the guys, the good guys who are looking for this are looking for patterns. it's very difficult. we have to understand that the government very truthful to us and we should trust them. >> fisa court very specific set up to allow warrants to search foreign intelligence people outside the united states and not by saying it might pass through a server that's google or yahoo and i happen to be an american and you might get mine too by accident. that's a violation of my rights and i'm very much against it by the way, we heard this week that the pope might have been data mined by the nsa.

in fridays, janet napolitano recently left her post as the secretary of homeland security to become university of california system. this week she raised eyebrows in her first address since taking office. listen. >> there is a subset, however, that deserves special mention. the subset of undocumented students. i'm going to set aside $5 million right now for this year to support these students with resources like trained advisors, student service centers, and financial aid. >> so the question is, why is ms. napolitano doing that joining us with geraldo rivera. 25,000 students, illegals are going to get instate tuition in california.

driver's license. >> if you are in california illegally and want to go to the university of california system one of the schools and get instate tuition but geraldo rivera wants to send one of his kids from new york or new jersey there pay out-of-state tuition. >> if we establish residence in the state of california. let me deal with the big issue. >> why would that be fair? if i come over from mexico or canada and i decide to plant my seed and my house in california, i'm going to be instate even if i'm illegal but me or you we can't do it, that's not fair. >> although immigration as you know is a federal issue, generally speaking, it's a federal issue and that's where the supreme court voided much of arizona's anti-immigrant legislation. in practical terms, states really set the tone and tenor of how undocumented our treated. in arizona, which borders california, as you know, it's very harsh, even those whose deportation has been postponed by the president's executive order which i know

urks you to no end they cannot get driver's licenses in the state of arizona. california though is much different. california suspect different demographically, also. i think therein lies the answer to your question. 38% of california is latino. that's over 15 million legal latino residents. it's a tremendous demographic. a tremendous voting block. and now to your question of the undocumented. there are 3 million or so undocumented people in the state of california, just 900 of them are attending the university of california. and those 900 out of 240,000 students, just 900 are now eligible. >> not a big program. >> not tax money. this is discretionary funds from janet napolitano, the now president of the university of california that she can help them, assist them with tuition and so forth. >> let's move on to news that broke late this week. in new york, the stop and

frisk law was put on hold by a judge. now there is another judge that says hold on, not so fast, judge shinelin. stop and frisk remains in play. your thoughts? >> the second circuit says this was a biased judge. she basically drafted the lawsuit. she has been very unfair to the nypd, and now the appellate court says judge, your rulings that it's unconstitutional are on hold, so, as of right now, stop and frisk, thankfully, in new york, that has made new york the safest big city remains on the books. >> because of stop and frisk. >> i believe stop and frisk has been an important role, has played important part mayor michael bloomberg new york we have one third or less the murder rate that chicago does. >> do you know what i would like to see? stop and frisk on the border. >> i think you have it. >> we are going to leave it there. geraldo, thank you very much. >> okay. >> when we come right back,

presidential race hits stores next week and already making headlines. according to the book president obama's top aids secretly considered replacing vice president joe biden with hillary clinton. but ultimately decided they wouldn't get enough of a political boost to justify such a bold move. joining me now to react examiner. and dr. larry sabato from the university of virginia center for politics and author of the new book the kennedy half century. larry, what are of the implications of this if true, what could have been with the implications of this especially with what's going on in benghazi. >> i'm glad you said if true. i wish the authors all the best. i know you have to come up with news nuggets to sell books. i think this was a low level discussion. it may have involved some high level aides, it was a low level low burned discussion that never got

serious. look, if obama had dropped biden what would we all have said he was admitting he made a big mistake in 2008 which when he put him on the ticket. this has happened over and over with incumbent vice presidents. i remember in 1992 when george h.w. bush was having trouble in the polls, some of his advisors talked behind the scenes and some to the press about dropping dan quayle and putting colin powell on the ticket? did it happen'? of course not. because bush would have admitted he made a big mistake in 1988 in putting quail on the ticket. >> susan, your thoughts. >> i will add to that, larry had he replaced quail he may have perhaps won re-election. that was one of the factors. people didn't like dan quail. i also think if the president's approval ratings got lower or stayed low that i think those low level discussions would have become high level discussions. this is all political calculation here. i think the president would have done anything to hold on to his seat.

and i think in the end he didn't need hillary clinton on the ticket. but, if he had really needed her, he would have used her and he would have dumped biden and he would have won. >> i guess you would have loved to be on that ticket. move on to the next one. next race in my home state new jersey. let's talk about chris christie. it looks like is he going to be an overwhelmingly huge winner so to speak. >> he absolutely is there is a silly, ridiculous discussion about what percentage does he have to get? it's going to make a big difference if he gets 61 rather than 59. this is absurd. >> what is incredible is that you have a republican who is at least conservative at least fiscally who is going to win a second term in a deeply blue state. you know, that's good news for republicans. they need to start winning some blue and competitive purple states to win the presidency. >> now, i will tell you, susan, a lot of talk in the state of new jersey,

especially among conservative circles is that some of what went on with hurricane sandy a year ago had a lot what's with what's going on tuesday in election in new jersey and then maybe 2016. >> that's part of it. is he definitely a pop police governor. he has found a way to appeal broadly to people across age, race and even party. this is really going to be playing into this election. but i think more broadly speaking, as larry was saying. maybe it doesn't matter what how big the number is, if he doesn't win by a blowout though i do think people will question how popular he can be on a general election ticket. and then moving forward how is his association with president obama and his appeal in a blue state going to help him if he decides to seek the republican presidential nomination when he has got a lot of conservatives who are going to really scrutinize him and question whether he is really conservative enough to be on a ticket. so kind of cuts both ways for christie. is he going to be a popular republican governor in a blue state. but what's that going to mean for him going forward when he tries to w the

republican nomination when you are going four the real conservative voters. >> let's talk about another governor's race. larry, start with you. this one in virginia. terry mcauliff and ken cuccinelli. it has been all over the board, has it not. right after the government shutdown it looked like mcauliff had a wider lead. that gap seems to be kind of closing. where do they stand? what do you think? >> well, the obama care controversy has, i think, cut a couple of points off mcauliff's margin. the problem for the republican ken cuccinelli is that mcauliff ran up the score when he could during the government shutdown and raising far more money than the republicans have been able to do for ken cuccinelli. >> so frankly he could have won by 10 i think mcauliff is more likely to win by 4, 5, 6, 7, something like that. look where they are winning? they are winning where they shouldn't in a blue state

with chris christie. they are losing where they should be winning in a purple state that has often voted republican, virginia. they have got to look at their two candidates, chris christie and ken cuccinelli and figure out what worked and what didn't, and how can we apply those lessons to 2016? >> not only that susan. let's talk about what larry just pointed out that what worked for -- what's working for chris christie may not be working for cuccinelli but also look at the other side. haven't democrats really pushed for terry mcauliff in virginia. you don't hear them pushing for chris christie's opponent in new jersey. >> well, that's partly again a political and financial calculation. because, they are not going to spend a lot of money in new jersey where chris christie is really going to blow this thing up by double digits. they need to be spending money in virginia right now. terry mcauliff is going to win. as larry was saying it's only by single digits which is not a run away victory. and terry mcauliff has very low approval rating and low popularity there. is he winning in part because people don't like

in the unresolved problem segment tonight, will the washington red since be forced to change their name. leadersy the united indian nation asked daniel snyder next week the city council is urging to adopt a new name. meanwhile, mr. snyder says the name is a, quote, badge of honor. how is this all going to play out? joining me now from los angeles with the very latest, fox news sports analyst jim grey. jim, really? really? i mean, we have done this over the years, right? they are still on this? >> well, yes, because it is offensive to some the native americans. and it's been growing because it's been picked up by some of the major media outlets this year says they won't use the term redskins in covering the team and printing it. so it has gained some

traction once again. this issue has been going on for years upon years upon years. i remember back in 1992 when i covered the buffalo bills playing the redskins in the metrodome in the super bowl and jack can cook on the team and there were some people from the tribe who came out and pictured the stadium that day. jack can cook. ignored it. commissioner did very little about it. so here we are some 21 years later still talking about it. >> what's the news, jim? this has been going back and forth. i mean, snyder said i'm not moving, it's a badge of honor. the united nations says we want you to move on it. >> well, they are not going to change the name. mr. snyder owns the team. ultimately it is his decision. no one can force him to change the name. he may receive pressure. but, if you look at the polling, his internal polling says that very, very few members of native americans are upset about are upset about it. about 10% in the last polling. 11% of the general public.

89% don't want a change. he has a fan base. it would kill them if he changed the name. they are entrenched redskins fans. however if you named a washington baseball team today and it wanted to be the redskins it would never fly. that's why they are the nationals. this has a tradition a history. it won't change. until there is a change of ownership or a rapid change in public opinion it's not going to happen. >> it's the wussification of america. stay strong, mr. snyder. cleveland indians, braves, blackhawks and hundreds of colleges use native american names. it's not offensive, is it? >> i'm not an indian. it's not offensive to me. if i was an indian and someone call ed me a redskin, yes, i
